En las últimas horas se produjeron trascendentes novedades en la causa que investiga la muerte en custodia de Leandro Bravo, de 37 años, ocurrida el 26 de febrero pasado en la ciudad de Charata, luego de ser detenido como sospechoso de un presunto delito. La más importante está relacionada con la detención de cuatro de los agentes policiales que intervinieron en la detención, ordenada por la fiscal en lo penal especial de Derechos Humanos adjunta, Silvia Slusar. Otro dato crucial es que estaría casi confirmado que la denuncia previa a la detención de Bravo fue falsa. Así lo atestiguó una mujer que declaró que fue inducida a denunciar por un agente policial, luego de que ya se había producido la muerte de Bravo.
Por otro lado, la Procuración General decidió reforzar la investigación judicial nombrando como coordinador al fiscal de Cámara de Sáenz Peña, Carlos Rescala, quién colaborará con la fiscal Slusar. Cabe recordar que en la causa también se constituyeron como querellantes el Comité para la Prevención de la Tortura del Chaco y la Secretaría de Derechos Humanos y Géneros.
Por otro andarivel también avanza la investigación administrativa que lleva adelante el Órgano de Control Institucional (OCI) de la Policía del Chaco que separó preventivamente de su cargo a uno de los agentes, que sería quién hizo firmar a una mujer una denuncia falsa contra Bravo, para justificar la detención y convertir en legal lo que a todas luces sería una detención arbitraria.
Críticas a los fiscales
El vicepresidente del Comité para la Prevención de la Tortura del Chaco, Kevin Nielsen, cuestionó duramente la actuación del fiscal que intervino durante las primeras horas de ocurrido el hecho, Hugo Baigorrí, quién se limitó a recabar únicamente los testimonios de los policías implicados, validando la versión policial de que Bravo fue detenido por una denuncia y se desvaneció mientras era trasladado.
“Más allá del encubrimiento policial, que tiene que ver con justificar posteriormente una detención que fue arbitraria, incorporando una denuncia de un hecho inexistente, lo que pudimos observar fueron errores palmarios en la investigación de los primeros días. Esto tiene que ver con el Poder Judicial, particularmente la fiscalía interviniente que solamente se abocó a tomar declaración a los policías implicados y no así a los testigos directos de este hecho. Porque recordemos que este hecho sucedió en horario de la siesta, ante la vista de por lo menos media docena de testigos”, señaló Nielsen, en declaraciones a CIUDAD TV.
“Esta investigación que debió haber sido realizada por la fiscalía, fue hecha por la familia de una manera muy valorable y destacable, una investigación rudimentaria, imaginemos que quienes deben investigar estos hechos, tomar declaraciones, y constituirse en la escena son los fiscales, aún cuando no sean los fiscales de Derechos Humanos, y fue la familia la que le recolectó una serie de testimonios, inclusive consiguió las grabaciones de las cámaras de seguridad antes de que estas se borren”, describió el miembro del Comité contra la Tortura.
“Si la familia no hubiese hecho esto, hoy estaríamos ante un caso donde por lo menos las grabaciones fílmicas serían inexistentes. Y esto coronado por una posible irregularidad en la primera autopsia sobre el cuerpo, que informó en una instancia preliminar no tener lesiones, que va a ser corroborado en la segunda autopsia”, adelantó. En ese sentido, reveló que desde el Comité para la Prevención de la Tortura del Chaco se solicitó a la fiscal Slusar que la segunda autopsia al cuerpo de Leandro Bravo sea realizada en Resistencia, bajo los parámetros del Protocolo de Minnesota, dada la mayor experiencia que acredita el equipo forense comandado por la directora del Instituto Médico de Ciencias Forenses (IMCIF), Gabriela Lamparelli.
